5 tips to handle getting sued

While not every gets sued it can happen to you in a business when you least expect it. For example somebody can slip and fall and claim that they were injured at your place of business or you can get sued for not paying a bill. The reasons can vary greatly but here are some tips so you know what you should do to handle getting sued.

Tip one:
If you are being sued you can try talking to the person or company who is suing you before your court date. Try to work out payment arrangements that you can stick to or try to pay off the debt in full. If you are not being sued for lack of payment you can try to work out a settlement arrangement before going to court. Even though the person who sued you went to court that does not mean that they are not open to discussing alternative arrangements. People usually use court as their final option, not as their first option. If the person is unwilling to settle with you directly try suggestion you go to mediation or other alternatives rather than going to court. Court can get expensive for both parties involved so seeking other solutions is in both of your best interests.

Tip two:
If you have never been sued before you should learn about how Small Claims courts work. You can do this by going to an actual court hearing to see what can transpire or you can you can read your state's courts websites, the website can also provide you with other useful links about what to expect in court and links to other resources that you might need for court or resources you can use to try and settle the claim outside of court.

Tip three:
You need to prepare for your actual court date. You do not want to wait until the last minute to prepare for the court so begin to prepare as soon as possible. Even though you might be trying to work out something without having to go to court is better to be prepared then to walk in empty handed. To help prepare yourself for court you should think about what you want to say to the judge and/or the party that is suing you, you should just get some general ideas in your head about what issues you want to address because when you get to court your "speech" might not be appropriate. You should also gather any evidence that you have to prove your case. For example if you are getting sued for non-payment and you have actually made these payments then bring in the cancelled checks showing the payments. You can also bring in any logs that show you have tried to work out this problem or anything else that pertains to your case. If you have witnesses that can support your case talk to them about coming to court with you to give their side of the story, the more evidence you have to back up your claim the better your chances are.

Tip four:
If you need more time to try and work out a settlement before your court date you can petition the court to extend the date. Beware you must have valid reasons for doing this so provide proof that you are working with the other party to settle this claim without going to court. It can be in your best interest to settle this out of court because if you do lose in court it could go on your credit report. Also do not just ignore the court summons as this can lead to a default judgment, even if you do owe the money you can still go to court to hopefully work out favorable terms.

Tip five:
Consult with a lawyer as soon as you get served with court papers. Do not put this off as it can cause more problems down the line. If you do not already have a good attorney you can ask friends, family members, or business associates for recommendations or you can do some research about lawyers online.
